Travel Intelligence Terms & Conditions

In the nine points below we’ve pulled out the most important terms and conditions for using the Travel Intelligence site. (And if there’s something that they don't cover, you can also refer to the lengthier description of the full legal TI Ts and Cs.)

1. Travel Intelligence acts as a booking agent for the hotel(s) on our site; we do not actually operate any of the accommodation services ourselves.

2. For all bookings, Travel Intelligence will take a credit card number on behalf of the hotel to guarantee the reservation. Once your booking is confirmed, you are subject to the hotel's own cancellation policy.

3. Upon making a hotel reservation payment to Travel Intelligence, your card will be charged at your bank’s rate of exchange for the hotel’s currency.

4. If any fees, payments or deposits are due in advance, these will be very clearly marked before you confirm your booking. Once these payments have been made, they are only refundable if the booking is cancelled within the hotel’s cancellation period.

5. Travel Intelligence does not charge any fees for amendments to bookings.

6. It is your responsibility to contact Travel Intelligence if you do not receive a confirmation email. If you think you haven’t received one, please check your junk mail folder to make absolutely sure.

7. Travel Intelligence cannot be held liable for errors or omissions in bookings made by hotels.

8. Hotel reviews shown on the site are the opinions of the individual travel writers, and do not necessarily represent the opinion of Travel Intelligence.

9. While we obviously do our utmost to ensure all information on the Travel Intelligence site is accurate, hotel facilities and other travel information may change at any time.

Conditions of Access

Access to the Site is free, but personal details are required to make hotel bookings. By submitting your personal details, you agree to comply with Travel Intelligence’s terms and conditions and Privacy Policy. These will prevail over any other terms or conditions contained or referred to in any other document and all such other terms and conditions are expressly excluded.

Copyright and Trademark Notice

All content, including but not limited to trademarks and taglines identifying our (or our affiliates') graphics, images, content, button icons, and service names are solely our property, that of our operating companies, writers or others. All content on this Site is protected by national and international copyright laws and treaties. Nothing on this Site should be construed as granting a licence or right to use any trademark displayed on this Site, without the written permission of the trademark owner.

Other than browsing and using the Site for its intended purpose, you may not in any way duplicate, distribute, modify, remove, delete, add to, publish, transmit, or in any way exploit any of the content of this Site, in part or in whole, except when expressly authorised in writing by us.

You may not use our logo for any purpose whatsoever, unless the intended use of the logo is to promote the services of this Site and has been approved by us in writing. We reserve the right to seek all remedies available in law, in equity or under international copyright laws for violations of these legal terms and conditions, including the right to block access from a particular internet address to the Site.

Limitation of Liability

The Site is provided on an 'as is' and 'as available' basis. TI makes no representations or warranties, and hereby excludes all warranties, express or implied, as to the quality, accuracy, feasibility or credibility of the content of the Site, the services available on or through the Site, or of any goods offered on the Site. Moreover, TI accepts no liability for any virus or any other type of electronic infection that may be transferred through the Site. Under no circumstance will we be liable for any loss or damage caused by a user's reliance on information obtained through this Site.

You agree as the user that the use of, or reliance upon, any of the content of the Site, and in particular any content recommending any hotel, product or service, is done entirely at your risk. The following provisions set out TI's entire liability (including any liability for the acts and omissions of its employees and agents) to you in respect of:

1. Any breach of its contractual obligations arising under the terms and conditions; and

1.1. Any representation, statement or tortious act or omission, including negligence arising under or in connection with the terms and conditions; AND YOUR ATTENTION IS IN PARTICULAR DRAWN TO THE PROVISIONS OF THIS SECTION.

2. Any act or omission on the part of TI falling within Clause 1 (above) shall, for the purposes of this section, be known as an 'Event of Default'.

3. TI's liability to you for death or injury resulting from its own or that of its employees' negligence shall not be limited.

4. Subject to the provisions of Clause 3 (above), TI's entire liability in respect of any Event of Default shall be limited to damages of an amount equal to any fee paid by you pursuant to these terms and conditions.

5. Subject to Clause 3 (above), TI shall not be liable to you in respect of any Event of Default for:

5.1. Loss of profits, business, contracts, revenues, anticipated savings or goodwill; or

5.2. any type of special, indirect or consequential loss (including loss or damage suffered by you as a result of an action brought by a third party) even if such loss was reasonably foreseeable, or TI had been advised of the possibility of you incurring the same; or

5.3. For any increased costs or expenses.

6. Moreover, TI accepts no liability for any virus or any other type of electronic infection that may be transferred through the Site.

7. If a number of Events of Default give rise substantially to the same loss, then they shall be regarded as giving rise to only one claim under the terms and conditions.

8. Nothing in this section shall confer any right or remedy upon you to which it would not otherwise be legally entitled.

9. TI will not be held liable to any third party in respect of any tortious act or omission including negligence resulting from the terms and conditions for:

9.1. Loss of profits, business, contracts, revenues, anticipated savings or goodwill; or

9.2. Any type of special indirect or consequential loss suffered by a third party even if such loss was reasonably foreseeable.

Other Sites

Travel Intelligence links out to a number of other websites. While we try wherever possible to make sure that these are the sort of sites we’d like to be associated with, we obviously can’t control and are not responsible for the privacy practices or content of these other websites, and therefore cannot accept any liability for their content or fitness for use.

General

Travel Intelligence does not assume any responsibility for failures or technical defects which occur due to events outside of its control. The exclusion of any user or any Content provided by a user or any delay, forbearance or indulgence by Travel Intelligence in exercising any right, power or remedy available to it shall not be deemed to be a waiver of that right and shall not preclude TI exercising that right at any subsequent time or on any subsequent occasion.

Severability

If at any time any provision of these terms and conditions are or become invalid or illegal in any respect, such provision shall be deemed to be severed from these terms and conditions but the validity, legality and enforceability of the remaining provisions of these terms and conditions shall not be affected or impaired. These terms and conditions are governed by and interpreted according to English law, and you and Travel Intelligence irrevocably agree that the English courts are to have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these terms and conditions. The facts, views and any other content presented on this site have not always been reviewed or approved by Travel Intelligence. Any view or opinion is that of the author and does not necessarily represent the views or opinions of TI and should not be attributed to TI.
